POVPlayer — Privacy Policy

1. Introduction
This Privacy Policy explains how POVPlayer, LLC ("POVPlayer," "we," "us," or "our") collects, uses, shares, and protects personal information when you use the POVPlayer video and media platform, including our websites, applications, media players, content libraries, and related services (the "Platform"). It is incorporated into and subject to our Terms of Service.
By using the Platform, you agree to the practices described here. If you do not agree, do not use the Platform.
2. Who This Policy Applies To
This Policy applies to:
- Individual users who create their own accounts.
- Sponsored users whose access is provided and managed by an employer or other organization (a "Sponsoring Organization"). See Section 9 — your activity and records may be visible to your organization's administrators.
- Visitors to our public websites.
Where a Sponsoring Organization controls how the Platform is used by its members, that organization is responsible for its own privacy practices and for informing its members about its use of their data.
3. Information We Collect
3.1 Information you provide
- Account and profile information — name, email address, and credentials used to register and sign in.
- Billing information — for paid subscriptions, billing details processed through our payment processor. We do not store full payment-card numbers; these are handled by the processor.
- User content — video, audio, images, playlists, comments, notes, and other material you upload or submit through the Platform.
- Communications — information you provide when you contact support or correspond with us.
3.2 Information generated through use of the Platform
- Playback and library data — content played, watch and listen history, resume-playback positions, playlists, libraries, favorites, ratings, and search queries.
- Media processing data — metadata derived from content you upload (such as duration, format, thumbnails, transcripts, and captions) generated to deliver, organize, and improve playback.
- Device and usage data — IP address, browser and device type, operating system, pages and features used, playback quality and buffering metrics, referring pages, and timestamps, collected through cookies and similar technologies (see Section 7).
3.3 Information from third parties
- Identity provider — when you sign in through our third-party identity service (including through an existing Google, Apple, Facebook, or Microsoft account, if you choose that option), we receive basic identifying information from that sign-in.
- Sponsoring Organizations — organizations may provide information to create and manage accounts for their members, including assigning roles and libraries.
We do not intentionally collect special categories of sensitive personal information, and you should not submit it through user content.
4. How We Use Information
We use personal information to:
- create and manage accounts and authenticate users;
- provide, operate, and maintain the Platform, including media playback, streaming, uploading, transcoding, and library features;
- maintain your viewing history, playlists, preferences, and cross-device resume-playback;
- process payments and manage subscriptions;
- operate AI features, including recommendations, search, transcription, captions, and summaries (see Section 5);
- provide customer support and respond to inquiries;
- monitor, secure, troubleshoot, and improve the Platform, including analyzing usage to develop new features;
- detect, prevent, and address fraud, abuse, security incidents, copyright infringement, and violations of our Terms; and
- comply with legal obligations and enforce our agreements.
5. Artificial Intelligence Features
The Platform uses AI to deliver and personalize features such as recommendations, search, transcripts, captions, translations, and summaries. Your inputs, uploads, and usage activity may be processed by AI systems, including third-party AI providers acting on our behalf, to provide these features.
We do not permit our AI providers to use your personal information to train their general-purpose models.
AI output may be inaccurate; this is addressed in our Terms of Service.
6. How We Share Information
We do not sell your personal information. We share it only as follows:
- Service providers (subprocessors) — vendors that perform functions on our behalf under contractual confidentiality and security obligations, including: cloud hosting and storage; content delivery and streaming infrastructure; identity and authentication; payment processing; AI model processing; email and notification delivery; and analytics.
- Sponsoring Organizations — for Sponsored users, we share account, library, and activity data with the administrators of your Sponsoring Organization (see Section 9).
- Other users — content, playlists, or comments you choose to share are visible to the users you share them with, as controlled by the Platform's sharing features.
- Legal and safety — when required by law, legal process, or government request (including valid copyright-infringement claims under the DMCA), or to protect the rights, property, or safety of POVPlayer, our users, or others.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy or a successor policy with comparable protection.
- With your direction or consent — when you ask us to share information or otherwise consent.
7. Cookies and Similar Technologies
We use cookies and similar technologies to keep you signed in, remember preferences and playback positions, secure the Platform, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect functionality.
8. Data Retention
We retain personal information for as long as your account is active and as needed to provide the Platform, and afterward as required to comply with legal obligations, resolve disputes, and enforce our agreements.
Uploaded content and its derived assets are retained while your account is active or until you delete them; copies may persist for a limited period in backups. When information is no longer needed, we delete or de-identify it.
9. Sponsored Accounts and Administrator Visibility
If your access is provided through a Sponsoring Organization, administrators of that organization can create, manage, suspend, or remove your access and can view records of your activity, libraries, and usage within the organization's account. Your use of the Platform under a Sponsored Account is also subject to your organization's own policies. Questions about how your organization uses your data should be directed to that organization.
10. Data Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit, and account isolation. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your account credentials.
11. Your Privacy Rights
Depending on where you live, you may have rights regarding your personal information. To exercise any right, contact us at privacy@POVPlayer.com. We will verify your request and respond as required by applicable law. You may also have the right to appeal a denied request or to lodge a complaint with a regulator.
11.1 US state privacy rights (including California)
If you are a resident of California or another US state with a comprehensive privacy law, you may have the right to:
- know and access the personal information we hold about you and how we use and share it;
- correct inaccurate personal information;
- delete personal information, subject to legal exceptions;
- obtain a portable copy of your information; and
- opt out of the sale or sharing of personal information and of targeted advertising.
We do not sell personal information and do not share it for cross-context behavioral advertising.
We will not discriminate against you for exercising your rights.
For Sponsored users, requests concerning data controlled by a Sponsoring Organization may be directed to that organization, and we may forward your request to it.
11.2 Other jurisdictions
If you are located in a jurisdiction with data-protection laws such as the EEA, United Kingdom, or Canada, you may have similar rights of access, correction, deletion, portability, restriction, and objection under applicable law, and the legal bases for our processing include performance of our contract with you, our legitimate interests in operating and securing the Platform, your consent where required, and compliance with legal obligations.
12. Children's Privacy
The Platform is intended for users 18 and older and is not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected such information, we will delete it. If you believe a minor has provided us information, contact privacy@POVPlayer.com.
13. International Users and Data Location
The Platform is operated from, and information is processed and stored in, the United States and other locations where we or our service providers operate. If you access the Platform from outside the United States, you understand that your information will be transferred to and processed in the United States, where data-protection laws may differ from those in your location.
14. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will provide reasonable notice, such as posting the updated Policy with a new "Last updated" date or notifying you. Your continued use of the Platform after changes take effect constitutes acceptance.
